Terms of Service

These terms are the agreement between you and Land & Herd for use of the Land & Herd website, web application, and the Land & Herd mobile apps for iOS and Android (together, the "Service"). They also serve as the end-user licence agreement for the mobile apps. By creating an account or using the Service you agree to them. If you don't agree, don't use the Service.

1. Your account

You must be at least 13 years old (or the age of digital consent where you live, if higher) to use the Service. You are responsible for keeping your password confidential and for everything that happens under your account. Tell us at [email protected] if you believe your account has been compromised.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for running your agricultural operation. You may not resell, sublicense, reverse engineer, or attempt to extract the source code of the hosted Service, or use it to build a competing product.

3. Your content

The records you enter — animals, tasks, logs, finances, and everything else — are yours. You keep all rights to them. You grant us only the licence we need to host, back up, and display that content to you and to the ranch members you have invited, and to operate and improve the Service.

You are responsible for the accuracy and legality of what you enter, and for having the right to enter it.

4. Acceptable use and zero tolerance for objectionable content

Land & Herd lets you invite other people into a shared operation, where they can see your log entries, notes, and records. We have zero tolerance for objectionable content and abusive behaviour. You agree not to upload, post, or transmit any content that:

• harasses, threatens, defames, or bullies any person;
• is hateful toward or discriminates against a person or group;
• is sexually explicit, or depicts or promotes violence, self-harm, or animal cruelty;
• is illegal, promotes illegal activity, or infringes anyone's intellectual property or privacy;
• contains malware, or is used to spam, phish, or gain unauthorised access.

You also agree not to interfere with the Service, probe or scan it, circumvent rate limits or access controls, or use it to store data unrelated to running an operation.

5. Reporting abuse

Ranch owners and managers can also remove a member from their operation at any time from the Staff page, which immediately revokes that person's access to the operation's data.

6. Suspension and termination

We may suspend or terminate your access if you breach these terms, if your use puts the Service or other users at risk, or if we are required to by law. You can stop using the Service and delete your account at any time — see landandherd.com/delete-account.

7. Availability and changes

We work to keep the Service available, but we don't guarantee uninterrupted access. We may add, change, or remove features. If we make a change that materially reduces core functionality, we'll give reasonable notice.

8. Not professional advice

Land & Herd — including any AI assistant feature — is a record-keeping and planning tool. It does not provide veterinary, medical, legal, financial, or regulatory advice. Withdrawal periods, treatment decisions, tax treatment, and compliance obligations are yours to verify with a qualified professional. Do not rely on the Service as the sole basis for a decision affecting animal or human health, or legal compliance.

9. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, Land & Herd is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or livestock losses. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or US$100.

11. Indemnity

You agree to indemnify and hold Land & Herd harmless from claims arising out of your content, your use of the Service, or your breach of these terms.

12. Apple and Google

If you obtained the mobile app from the Apple App Store or Google Play: this agreement is between you and Land & Herd only, not with Apple or Google. Apple and Google have no obligation to provide support for the app. Apple and Google are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list. Any claim that the app fails to conform to a warranty may be directed to Apple, which may refund the purchase price; beyond that, Apple has no warranty obligation. You also agree to comply with the applicable App Store or Google Play terms.

13. Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules, and the courts located there have exclusive jurisdiction — except where your local consumer law gives you the right to bring a claim elsewhere.

14. Changes to these terms

We may update these terms. We'll change the date at the top and, for material changes, notify you in the app or by email before they take effect. Continuing to use the Service after that means you accept the new terms.
